Derek started a new business venture last year and asked his friend Sally to lend him $50,500. Sally, being a good friend, lent him the money. He promised to pay back within 6 months. After a year Sally has still not been paid. Sally asked Derek to pay back the money but he refused and avoids Sally by all means.

She now prepares to sue Derek to recover the money but Sally dislikes the lawyers and wants to save potential cost in case she fails.

Q1.Which court/tribunal can Sally proceed her case? Describe the advantages and disadvantages of the respective options available to Sally and advise Sally her best choice. Explain your answer.

Q2.Sally considers to proceed the case by reporting to the police. Is there any difference in terms of standard of proof in the court?

    1. Small claims court.

    2. Did you write the following document at the time you lent money to that person? Certificate of Indebtedness (signed by both parties). It is even better if it is notarized. Without this piece of important document, it's tough to take this to court or file a police incident report.
